Welcome to Budget Depot! This website is operated by Budget Depot. These Terms and Conditions govern your use of our website and the purchase of our products. By accessing or using our website and purchasing our products, you agree to be bound by these Terms. Please read them carefully before using our services.
In these terms and conditions, the expressions “we”, “us” and “our” are a reference to Budget Depot.
1. Acceptance of Terms
By using our website, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.
2. Products
a. Product Descriptions: We strive to provide accurate descriptions and images of our products. However, we do not guarantee that the descriptions, images, or other content on our website are completely accurate, complete, reliable, current, or error-free.
b. Availability: All products are subject to availability. We reserve the right to limit the quantity of products we supply, supply only part of an order, or to divide orders for shipment.
3. Orders and Payment
a. Order Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason.
b. Payment: Payment for products must be made in full at the time of purchase. We accept Visa and Master cards. All prices are in Australian dollars (AUD) and are subject to change without notice.
c. All payments are handled by a secure payment gateway provider and will appear on your account statement as coming from Budget Depot.
You must ensure you provide your correct billing details when checking out, as incorrect information may delay your order. If we cannot complete your order, some items cannot be shipped or we reject your order, we will refund you using the original payment method used for the order. Please
be aware that refunds may take several business days to appear on your statement.
4. Shipping and Delivery
a. Shipping: We offer shipping to various locations within Australia. Shipping costs and delivery times vary depending on the destination and shipping method chosen. Delivery times are estimates and not guaranteed.
b. Our delivery partners will deliver your order using the name, address and telephone details you provide us with when completing your order. We are not liable for any mis-delivery due to inaccurate delivery details provided by you.
c. Risk of Loss: All products purchased from our website are made pursuant to a shipment contract. The risk of loss and title for such products pass to you upon our delivery to the carrier.
d. Authority to Leave Disclaimer: By selecting the “Authority to Leave” (ATL) option, you authorize the delivery carrier to leave your parcel at the designated delivery address without requiring a signature. You acknowledge and accept the following conditions:
1. Risk Assumed by Recipient: Once the parcel is delivered and left at the specified location, responsibility for the parcel transfers to you. This includes any risk of loss, theft, or damage.
2. No Liability for Lost or Stolen Items: Budget Depot and the delivery service will not be held liable for any parcels that are lost, stolen, or damaged after delivery has been completed under ATL instructions.
3. Appropriate Delivery Location: It is your responsibility to ensure that the nominated delivery location is safe and secure for unattended delivery.
4. No Redelivery Available: If ATL is selected, the delivery will not be reattempted or redirected. The parcel will be left as per the instructions.
By proceeding with ATL, you confirm that you have read, understood, and agreed to these terms.
e. Re-Delivery Fee: In the event that Authority To Leave delivery attempt is unsuccessful due to reasons beyond our control (including but not limited to: recipient unavailability, incorrect address details provided, refusal to accept delivery, or inaccessible delivery location), a re-delivery fee will apply.
An additional fee of up to $20 will be charged. This fee must be paid in full before the re-delivery is scheduled. The amount of the re-delivery fee will be communicated to the customer and may vary depending on the delivery location and circumstances.
By placing an order, you acknowledge and agree to be responsible for any re-delivery fees that may arise as a result of failed delivery attempts.
5. Returns, Refunds
a. We do not accept returns due to change of mind. However, we will gladly accept a return of faulty/ incorrect products provided:

You contact us within 7 days of dispatch of the products; and the products are returned in original condition and sealed (unless the products are faulty).

Please note once the 7 day period has passed, we will not accept any return of products.
b. If you are returning the products because:

you received incorrect products, we will at our option, either replace the incorrect product or we will refund you;

we pack fragile items to the best of our ability to ensure they do not get damaged during transit. If fragile items gets damaged during transit, Budget Depot is not responsible and will not replace or compensate for the damage unless you had shipping insurance included in your order. You will need to contact us within 7 days of receiving the parcel and include photos in the email. Any claims made after 7 days will not be eligible for replacement or compensation.

We take care in packaging all orders securely, however, occasionally boxes may be damaged while in transit, we do not offer refunds or replacements on products if only its packaging is damaged.

A return label will be emailed to you and the parcel will need to be dropped off at a post office.
c. Unless we reasonably determine the product is being returned due to our error or product fault:

you are responsible for any shipping charges on returned products; and we will not refund you the delivery fee originally paid.

You must ensure you obtain proof of postage and tracking to cover the unlikely event that the parcel is not returned to us.
To request a refund, please contact the customer service team at hello@budgetdepot.com.au and quote your order number. We will assess all claims individually and if we approve your return for a refund, we will credit the purchase price for that product using the original form of payment used to make the purchase.
6. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Budget Depot and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from our website without our express written permission.
7. Liability
Budget Depot is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our website or products, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless Budget Depot, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney fees, arising out of or in any way connected with your use of our website or products.
9. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our website following any changes constitutes your acceptance of the new Terms.
